{"id":931,"date":"2017-05-10T13:23:37","date_gmt":"2017-05-10T11:23:37","guid":{"rendered":"https:\/\/lexgoapp.com\/blog\/?p=931"},"modified":"2023-04-17T00:39:58","modified_gmt":"2023-04-16T22:39:58","slug":"por-favor-vete-ya-impagos","status":"publish","type":"post","link":"https:\/\/lexgoapp.com\/blog\/por-favor-vete-ya-impagos\/","title":{"rendered":"\u00a1Por favor, vete ya!"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">La crisis econ\u00f3mica que ha azotado el pa\u00eds en los \u00faltimos a\u00f1os, afect\u00f3 a todos los mercados incluido el arrendaticio. Como consecuencia de ello se han incrementado exponencialmente los casos de impagos de las rentas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El primer problema con el que nos enfrentamos los abogados especializados en este \u00e1mbito es que el arrendador, con el fin de evitar entrar en conflicto con el arrendatario o con la esperanza de que el problema se resuelva por s\u00ed solo, permite al inquilino el impago de varias mensualidades antes de ponerse en manos de profesionales.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este significa que, cuando se inician los tr\u00e1mites ya se encuentran pendientes varios pagos por rentas vencidas y no satisfechas. Por tanto el primer consejo que se debe dar al cliente es el de \u00a0<\/span><b>informarse ante el primer impago.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">No debemos olvidar que el art\u00edculo 27.2.a de la Ley de Arrendamientos Urbanos ya autoriza al arrendador a <\/span><i><span style=\"font-weight: 400;\">resolver el contrato como consecuencia de la falta de pago de la renta o de cualquiera de las cantidades cuyo pago haya asumido o correspondan al arrendatario.<\/span><\/i><span style=\"font-weight: 400;\"> Por eso, la jurisprudencia permite reclamar desde el impago de la primera mensualidad. En este sentido la Sala 1\u00aa del Tribunal Supremo ha fijado doctrina jurisprudencial entre otras en la Sentencia de la Sala Primera del Tribunal Supremo de 10 de noviembre de 2010, 2161\/2006 \u2013 EDJ2010\/253931):<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201cEsta sala ya ha fijado como doctrina jurisprudencial (SSTS 19 de febrero de 2008, RC 648\/2004- EDJ 2008\/234528-, 26 de marzo de 2009 RC 1507\/2004- EDJ2009\/72814-, entre otras) que el pago total de la renta del arrendamiento de una vivienda, fuera de plazo y despu\u00e9s de presentada la demandada de desahucio, no excluye la posibilidad de resoluci\u00f3n arrendaticia, y ello aunque la demanda se funde en el impago de una sola mensualidad de renta, sin que el arrendador venga obligado a que el arrendatario se retrase de ordinario en el abono de las rentas peri\u00f3dicas\u201d.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Ante el impago de la primera mensualidad, nuestra recomendaci\u00f3n ser\u00eda avisar al arrendatario, mediante cualquier medio fehaciente, por ejemplo burofax, que si no se pone al corriente de forma inmediata de las cantidades pendientes, se proceder\u00e1 a la reclamaci\u00f3n por v\u00eda judicial. En este momento ya se aconseja avisar al arrendatario de las consecuencias, posiblemente irreversibles, de la acci\u00f3n de desahucio por falta de pago.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Con esta medida vamos a conseguir dos cosas: La primera es evitar que el arrendatario enrede la situaci\u00f3n con promesas de pago verbales, que luego no se cumplen o similares y, mientras tanto, la deuda se va incrementando. La segunda es impedir la enervaci\u00f3n de la acci\u00f3n conforme al art\u00edculo 22.4, p\u00e1rrafo segundo de la Ley de Enjuiciamiento Civil que dispone:<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">\u201cLo dispuesto en el p\u00e1rrafo anterior no ser\u00e1 de aplicaci\u00f3n cuando el arrendatario hubiera enervado el desahucio en una ocasi\u00f3n anterior, excepto que el cobro no hubiera tenido lugar por causas imputables al arrendador, ni cuando el arrendador hubiese requerido de pago al arrendatario por cualquier medio fehaciente con, al menos, treinta d\u00edas de antelaci\u00f3n a la presentaci\u00f3n de la demanda y el pago no se hubiese efectuado al tiempo de dicha presentaci\u00f3n\u201d.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Por ello, nuestro segundo consejo es <\/span><b>dejar transcurrir 30 d\u00edas antes de presentar la demanda.<\/b><span style=\"font-weight: 400;\"> Si vencido el referido plazo sin haber recibido el abono de las cantidades pendientes, acudiremos, sin m\u00e1s tr\u00e1mite, a la v\u00eda judicial para solicitar el desahucio por falta de pago, acumulando la acci\u00f3n de reclamaci\u00f3n de las cantidades adeudadas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Para evitar problemas procesales que pudieran dilatar el procedimiento, nuestro tercer consejo es <\/span><b>acompa\u00f1ar a la demanda una nota simple acreditativa de la propiedad, el contrato de arrendamiento, las cantidades adeudadas debidamente justificadas y la comunicaci\u00f3n fehaciente realizada al arrendatario<\/b><span style=\"font-weight: 400;\">. Obviamente esta enumeraci\u00f3n es una lista de m\u00ednimos, cualquier otra documentaci\u00f3n que sustente nuestra reclamaci\u00f3n, siempre ser\u00e1 bien recibida por el juzgador.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En resumen, el arrendador debe tener claro los siguientes puntos: No dejar que el arrendatario incremente su deuda en m\u00e1s de una mensualidad. En ese momento requerirle el pago mediante cualquier medio fehaciente. Una vez transcurrido el plazo exigido por la Ley de Enjuiciamiento Civil para evitar la acci\u00f3n de enervaci\u00f3n, sin que se haya cancelado la deuda, proceder a interponer la demanda de desahucio acumulando la petici\u00f3n de reclamaci\u00f3n de cantidad.<\/span><\/p>\n<p>Estanislao forma parte de un despacho multifuncional especialistas en derecho civil y administrativo.
