Cedemos parte de nuestra vida profesional para traer otra vida al mundo, y algunos empresarios se creen con derecho de despedir a trabajadoras por estar embarazadas, siendo ello una vulneraci\u00f3n de nuestros derechos fundamentales.<\/em><\/p>\n<hr>\n<p>Este es el caso de la sentencia que comentamos a continuaci\u00f3n. Una trabajadora en per\u00edodo de prueba, coge la baja m\u00e9dica por embarazo de riesgo y a la vuelta, le comunican que van a rescindir su contrato.<\/p>\n<p>En el supuesto de los per\u00edodos de prueba, la empresa no tiene porque justificarse, pueden restringir el contrato, solamente con la comunicaci\u00f3n de que no se ha superado el per\u00edodo de prueba. En este caso cuando se presenta la papeleta de conciliaci\u00f3n no hay acuerdo entre las partes, porque la trabajadora considera que su trabajo ha sido bueno y que el despido tiene base en su estado, por ello demanda a la empresa.<\/p>\n<p>Cuando se ven indicios de discriminaci\u00f3n de sexo (art\u00edculo 14 de la Constituci\u00f3n), es la empresa la que tiene que justificar objetiva y razonablemente la decisi\u00f3n de la empresa. \u00c9sta&nbsp; intenta justificar su despido por medio de gr\u00e1ficas, que no convencen al juez, adem\u00e1s de que intentan convencer de que el despido estaba planeado meses antes, pero lo efectuaron a la reincorporaci\u00f3n al trabajo.<\/p>\n<p>La pregunta que todo el mundo se har\u00eda es \u00bfpor qu\u00e9 si la empresa quer\u00eda rescindir su contrato antes de saber que estaba embarazada no se despidi\u00f3 en su momento, por qu\u00e9 se esperaran a su reincorporaci\u00f3n?<\/p>\n<p>Esta pregunta ser\u00e1 la que probablemente demostr\u00f3 la discriminaci\u00f3n por raz\u00f3n de sexo, por ello, se declara nulo el despido, teniendo la empresa que readmitir a la trabajadora y abonando los salarios atrasados.<\/p>\n<p>Siempre pensamos que los trabajadores estamos indefensos, y puede ser que en los \u00faltimos a\u00f1os se hayan perdido derechos, pero esto no significa que no hagamos valer los que tenemos, que son nuestros Derechos Fundamentales.<\/p>\n<p>Si luchamos por lo que consideramos nuestros derechos, los conseguiremos.
